Drunk Man Who Killed Cop in Commack Goes Free

Jose Borbon spends less than three years behind bars after his DWI conviction in the death of Suffolk officer Glen Ciano.

A drunken Plainview man who plowed into a patrol car and killed a Suffolk County police officer was freed from an upstate prison Monday.

Jose Borbon was originally sentenced to 1 1/2 - 4 years on the charge of first-degree vehicular manslaughter and one year for driving while intoxicated for causing the fiery crash that claimed the live of Suffolk Officer Glen Ciano.

Borbon, a father of two, spent two years and eight months imprisoned, including nine months in the Gowanda medium security state prison in Western New York. He was credited with time served in the Suffolk County Jail awaiting his trial and sentencing. He'll remain on probation for some time.

Ciano was responding to a call for help from a fellow officer when Borbon's Dodge Magnum smashed into Ciano's vehicle, sending it careening into a utility pole and exploding into flames on Feb. 22, 2009. The crash occurred on the Vanderbilt Motor Parkway near Commack Road in Commack.

State Supreme Court Justice Robert W. Doyle issued the orginal sentence, the result of a plea deal. Borbon could have faced considerably more jail time -- perhaps 10 years -- if the case went to trial. At the sentencing, Ciano's daughter, Samantha, who cried openly during the proceedings, said "Overnight I lost the man who always made me feel safe and loved...the man who always inspired me," she said.

"This is a horrible consequence of this man's selfish act."

The Suffolk County PBA posted a News 12 video on YouTube here.

Well isn't this just precious. Does he also get to have a Drivers License? Just another example of a society that has gone wimpy. Ah, what the heck, our wonderful judicial system might as well give him a 6 pack along with some car keys.

It's great to know a creep like Borbon with his neck tattoos and shaved eyebrows will be roaming around the area, just waiting to ruin another families life. Keep making laws you political losers, but don't bother enforcing them with real penalties.

Ridiculous - freakin perp was caught DWI several weeks before, but was still allowed to drive around. Now he's free again. Great system we have where people spend 10 years locked up for offenses that are politician's pet statues, but go free for this. Heart goes out to the Ciano family.

What a horrible tragedy! In my opinion, drunk drivers are the worst bottom feeders there are! They are all premeditated murderers whom if they just happen to be lucky and not get into an accident, only means that they missed their mark! They all made a conscious decision to drink and then get behind the wheel of a 2 ton bullet while severely impaired! But almost as bad are the scum bag lawyers that get them off! Only 3 years? What about the lifetime Officer Ciano's children will have to grow up fatherless? A Loving father ripped out of their lives because of the selfish acts of a repeat offender! Unfortunately, it doesn't matter if his license is revoked or suspended. Don't you know its only illegal to drive with a revoked or suspended license if you get caught!
