Report: Ice Cream Store Sues Fox 5 Reporter

Chain is suing Fox 5 after reporter Arnold Diaz criticized stores in a "Shame, Shame, Shame" segment.

The owner of three D'Lites Emporium ice cream stores is suing Fox 5 News reporter Arnold Diaz for a "Shame, Shame, Shame" segment that accused the chain of  misleading customers, according to a New York Daily News report.

Owner Matthew Prince called the segment "grossly irresponsible" in a lawsuit filed against Fox 5 and parent company News Corp Monday in Manhattan Supreme Court, according to the Daily News. Prince is set to open stores in Commack and Bayside this summer. The Babylon franchise store opened in late May on the corner of Deer Park Avenue and Main Street.

A Patch writer's call to the store was referred to the owner's attorney who had not returned the call by press time.

In the eight-minute segment, Diaz blasted the Florida-based chain for mislabeling ice cream as "low in sugar" and "low carb." Tests performed at an independent laboratory on behalf of the news channel revealed the fat, sugar and carbohydrate content were much higher than advertised, Diaz said in the segment.

D'Lites Emporium markets itself as a "healthier alternative" to traditional ice cream.

The lawsuit states News Corp ignored reports that backed up D'Lites nutritional claims.

Although the heated confrontation took place at the chain's Woodbury store, Prince, one of the chain's several lincensees, says additional expansion plans have fallen through since the segment aired last month.
